Preamble
Allen Digital Pty Ltd ("FlyHire", "we", "us", "our") operates an online marketplace at flyhire.com.au that connects aircraft operators with pilots seeking to hire aircraft. These Terms and Conditions ("Terms") govern access to and use of the FlyHire platform, website, and related services.
By registering for or using the FlyHire platform in any capacity, you agree to be bound by these Terms. If you do not agree, you must not access or use the platform.
1. Definitions
| Account | A registered user account on the FlyHire platform, whether for an Operator or a Pilot. |
| Aircraft | Any aircraft listed by an Operator on the platform for hire, including aeroplanes, helicopters, and other airworthy aircraft. |
| Booking Enquiry | A request submitted by a Pilot to an Operator through the platform to hire Aircraft. |
| CASA | The Civil Aviation Safety Authority of Australia. |
| Fees | The fees payable to FlyHire as set out in these Terms and on the platform. |
| Operator | A person or organisation that lists Aircraft for hire on the platform. |
| Pilot | A person who registers on the platform to search for and enquire about Aircraft for hire. |
| Platform | The FlyHire website, web application, APIs, and any associated services operated by FlyHire. |
| Pro Account | A paid Pilot subscription providing access to enhanced platform features. |
2. Acceptance of Terms
2.1 These Terms constitute a binding legal agreement between you and FlyHire.
2.2 If you are entering into these Terms on behalf of a company, you represent that you have the authority to bind that entity.
2.3 We may update these Terms from time to time. Continued use of the platform after the effective date of any changes constitutes acceptance.
3. Nature of the Platform
3.1 FlyHire is a marketplace platform only. We do not own, operate, maintain, or insure any Aircraft listed on the platform.
3.2 FlyHire does not act as a broker, agent, lessor, or operator. Any hire arrangement is a direct agreement between the Operator and the Pilot.
3.3 FlyHire does not verify the accuracy of information provided by Operators or Pilots. Each party is responsible for their own due diligence.
4. User Accounts
4.1 You must register for an Account to access most platform features and provide accurate, complete information.
4.2 You must not share your Account credentials with any third party.
4.3 You must be at least 18 years of age to create an Account.
4.4 FlyHire reserves the right to suspend or terminate any Account for breach of these Terms.
5. User Content
5.1 You retain ownership of any Content you submit. By submitting Content, you grant FlyHire a non-exclusive, royalty-free licence to use it for operating the platform.
5.2 You warrant that any Content you submit is accurate and does not infringe third-party rights or applicable law.
6. Prohibited Conduct
You must not impersonate others, post false content, circumvent platform security, scrape data, or use the platform to solicit transactions outside it to avoid Fees.
7. Privacy
FlyHire collects and processes personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). Contact support@goflyhire.com for privacy enquiries.
8. Intellectual Property
The FlyHire platform, design, software, trademarks, and original content are owned by or licensed to FlyHire and protected by Australian and international intellectual property laws.
9. Limitation of Liability
9.1 To the maximum extent permitted by law, FlyHire excludes all liability arising from your use of the platform or any hire arrangement.
9.2 Where liability cannot be excluded under Australian Consumer Law, FlyHire's liability is limited to resupply of the relevant service or the fees paid in the preceding 12 months.
10. Indemnity
You indemnify FlyHire and its officers against any claim, loss, or expense arising from your use of the platform, your Content, or any hire arrangement to which you are a party.
11. Dispute Resolution
Disputes must be notified in writing to support@goflyhire.com. If unresolved within 14 days, either party may refer the dispute to mediation. These Terms are governed by the laws of Queensland, Australia.
12. General
If any provision is held invalid, the remaining provisions continue in full force. FlyHire may assign its rights; you may not without our consent. These Terms constitute the entire agreement between you and FlyHire.
Schedule A — Operator Terms
These terms apply in addition to sections 1–12 above.
A.1 Listings
Operators must accurately describe Aircraft including make, model, registration, and base location. FlyHire may remove any Listing at its discretion.
A.2 Eligibility & Compliance
By listing an Aircraft, the Operator warrants that they are legally authorised to offer it for hire, the Aircraft holds a valid Certificate of Airworthiness, all CASA requirements are satisfied, and the Aircraft is adequately insured for hire operations.
A.3 Booking Enquiries
Operators are not obligated to accept any Booking Enquiry. Operators must independently verify that any Pilot holds the required licences before allowing them to operate the Aircraft.

All fees are payable in advance and are non-refundable unless otherwise stated or required by law.
Schedule B — Pilot Terms
These terms apply in addition to sections 1–12 above.
B.1 Free Account
Free accounts provide: a pilot profile, up to 2 saved search filters, email notifications, and up to 3 Booking Enquiries per calendar month.
B.2 Pro Account
The Pro Account subscription is AUD $5.00 per month (including GST) and includes: CASA ARN, licence, and medical verification; unlimited saved search filters; email & SMS notifications; unlimited Booking Enquiries; and credentials auto-appended to enquiries.
Pilots may cancel at any time. Upon cancellation, Pro access ceases immediately with no partial-month refund unless required by law.
B.3 Pilot Responsibilities
Pilots are solely responsible for holding the required CASA licences, ratings, and medical certificates for any Aircraft they hire. Pilots must not misrepresent their qualifications to Operators.
B.4 Pilot Verification
A verification badge indicates only that FlyHire has sighted submitted documentation — not that it is current or valid. Operators must independently verify qualifications.
